My case is EB2 PD is Sep 06
Due to this event in July, I think I can file 485 now. However, there comes a problem making me feel really confused
My 2nd H1b will expire in Jan 08 and I really have no idea how long I will get EAD if I file 485 now. Obviously, there will be Huge amount of 485 cases going to CIS now and accordingly there will be a lot of EAD application at this moment. I think nobody can make sure whether EAD processing time will be the same as before. if it takes over 6 months, then I will be out of status.
What I am concerned is if I can not get EAD before Jan 2008, can I file H1b Extension over 6 yrs at this time. However, it seems that if I file 485 now then I will NOT be eligible to file H1b extension over 6 yrs.
It's really a tough decision. Nobody will let this chance to file 485 go but it seems really risky for me to get EAD in time before expiration of my h1b.
Can anyone give me a suggestion
