I just got I485 rfe

-You were last admitted to the US as a J1 nonimmigrant on XX 2004. Please submit evidence to establish that as of September 29 2005 (the date that you filed Form I485):
a) you has complied with the requirement of residing and being physically present in his country of nationality or last residence for an aggregate of at least two years following departure from the US; or
b) you have obtained a waiver of the requirement of residing and being physically present in his country of nationality or last residence for an aggregate of at least two years following departure from the US, or
c) you are not subject to the requirement of residing and being physically present in his country of nationality or last residence for an aggregate for an aggregate of at least two years following departure from the US.

concurrently filed I140/I485 on 9/29/2005
I140 AD: 7/7/2006
used two EADs to work , currently AOS
two fingerprints, latest in May 2007.

I was told that I could use favorable recommendation letter to file I485. I don't know where it comes to support that I485 could be filed only with DOS recommendation letter. My No Objection-based J1 waiver really sucks. The recommendation letter from DOS was dated on August 23 2005. But my I612 was pended for almost 2 years. I recieved the final approval notice this April.

Could you help me on how to response to this rfe? I need get the guide/law verifying that I485 could be filed with the DOS recommendation letter. Is it enough to point out that USCIS delayed my I612 and only attach DOS letter and USCIS final approval notice dated in April 2007. Thanks in advance.
