I have approved Labor Certificate but have not filed I140 yet. I asked my attorney to file I140 and I485 concurrently in July but he said:
"The new EB3 I-140 on your behalf will not be eligible for concurrent
filing with an AOS. We are recommending that the EB3 I-140 be prepared
and filed as early as next week. We hope to receive the receipt notice
prior to the August 17th deadline, to be able to file the AOS
applications based on the July Visa Bulletin. AOS applications must
include evidence of a pending or approved I-140, or it may be rejected
by the CIS.
Additionally, if Premium Processing of I-140 becomes available again in
August, we recommend converting it to Premium Processing so we will have
the receipt confirmation for the I-140."
Can anybody help me to understand what my attorney said?
