My H1B status (non profit organization) expired on July 14. I did not submit H4 until July 19. A professor in the same department is giving me an offer. Now the international student office is giving me several options for getting an H1B.
1. (their most recommended one) Going back to China, and they will mail me a new H1B, and I will come back with the new H1B.
2. Going back and coming back as an H4, then applying for a new H1B
3. Doing H1B extension with a letter of explanation of the whole situation why I had a gap in the employment.
My lawyer filed 140 on July 2 (NIW based) and am ready to submit 485 tonight (dated back to July, 02, which my lawyer says OK).
Which option should I take? Or any other advice?
