I-94 expiration date is last October which is the passport expiration date. In last Semptember, I had the passport renewed. Then my company filed an I129 (H1B extension) for me at early October, 2003 to correct the I94 expiration date. But have not received the new I-94 from CIS.
In Dec. 2003, spouse filed I-485 in which I was included as a dependent. Now I already got the EAD and AP.
My Question:
1) If I quit my job, do I have a legal status? I think if I quit, my company will withdraw the I129 application, then I will not get the new I94. How can I prove that I am not staying here illegally since last October as the 485 is filed later in December?
2)If I go back to China for a while, can I come back using AP? I am worrying about the I94 because it is already expired. If I have the I129 receipt notice on hand, is it safe?
