Here is my situation,
(1) Currently in US working with H1B visa expiring in 2009
(2) Married, my wife holds H4
(3) I-140 approved
(4) I-485 filed in early July this year, have not received receipt notice, do not have AP and EAD
(5) Applied Maple Card and got approved recently and will land in Sep
(6) My wife will stay there after landing and I will come back to US
Here are my questions,
(1) Can I apply for the 10 year multiple-entry B1 visa with my situation? I heard that since my I-140 has been approved I can't apply for B1 visa because I am on H1B visa? Is this true and why?
(2) If I can't apply for B1 visa can I apply for multiple-entry H1B visa as a Maple Card holder? I heard that I can get 5 (?) year multiple-entry H1B as a Canadian PR? I know normally the H1B visa has 2 entries, is there an exception for Maple Card holders?
(3) If there is no such thing as multiple year multiple-entry H1B visa, is there any additional risk for me to go apply for the regular H1B visa in Canada? The risk is that associated with the fact that my I-140 has been approved and my I-485 is pending. I know I can wait to get my AP but how about before that?
(4) If I can apply for B1 visa as described in (1) can I apply before I get the Maple Card? Normally it takes a few weeks to get the card, since I will only be there for a few days after landing I wonder if I can use any document to apply for the B1 visa?
(5) How about my wife? Is there risk for her to apply the 10 year B1 visa since I am in the middle of immigration to US?
(6) If I visit her by driving does my passport get stamped either way (US or Canada) or this depends?
