Most of the PERM or BEC labor certification application cases which were filed prior to August 1, 2007 and certified before August 18, 2007 received the benefit of July 2007 VB fiasco and USCIS decision opening the door wide for I-485 filing during the period. However, there were still a large number of cases within the DOL foreign labor certification system which had not been certified during the period. This is particularly noticeable with the Atlanta National Processing Center cases. Since there was a total vacuum of 30 days in August for any I-485 filings other than July 2007 VB fiasco cases, most of these cases are expected to be filed in September when visa numbers will be reopened for every EB categories other than "other workers." There were some immigrants who lost their breath on August 17, 2007 when they were unable to file their EB 485 applications because they had not received the labor certification approval before the date. The new opportunity will open for these immigrants beginning from September 2007. The only people who should keep fuming may include those whose priority date will not become current in September VB and in that regard, they lost the golden opportunity to file ther 485 applications regardless of their priority dates during the historical July 2007 VB fiasco period. Well, didn't someone say that life is a gamble?
