My PD was Feb 06, so I should have sent in my I485 packet in July. Because of my ignorance, the packet was received by the USCIS (Nebraska center) on Friday, June 29. Later when I called the customer service line, one rep told me I should cancel the check to stop that packet because it's earlier than allowed by 2 days and it will be returned once USCIS found out about that. So I did stopped the check and in the meantime I sent in a second packet which arrived at the Center on July 23. Two weeks ago, I got a receipt notice on my first I485 application (the one arrived on June 29) and a week ago I got finger print notice for the same application. When I first got the receipt notice, I called my bank and asked to remove the stop on the check so it will go through (the bank told me the USCIS had not attempted to cash the check, which I found out to be wrong info). Today, I got a notice from USCIS asking for payment ($395 plus $30 fee for bad check). Can anyone with similar experience or knowledge advise me:
Should I go ahead make the payment for the first I485 even though it was two days earlier than allowed? Or should I withdraw the first application and wait for the receipt and finger print notice for my second (the correct) application? Should I still go to the finger print appointment that is coming up next week? Did it ever happen to anybody that an application was returned because it's a couple days earlier? Very very frustrated, please help!
