My hu*****and got a H1B at "A" company. He was laid off by "A" company a few months ago. He immediately filed his H4 on July 17 and his H4 is still under pending. ("A" company has sent a notice to the USCIS) Now "B" company gave him an offer and would like to support his H1B application with premium process. But the lawyer in "B" company didn't know what his current legal status is. When he is filed his H1B petition, should he change his status from H4 (still pending) to H1B, or "straight" petition, that is transfer from his old H1B (not effective now) to a new H1B? We have to answer it tomorrow. Please give me a help!!! Thanks a lot.
