My I-485 was filed in Sep. 2006 as a dependent of my hu*****and's eb1 case. His case was approved in July 2007. My case is very strange. In Dec last year, I got notice from USCIS saying that my case was sent to Administrative Appeal office for review. That's the last update I have, not even any fingerprint notice.

I went to Infopass. I asked the officer why my case was sent to AAO. She said she didn't any more information than I had. She said based on this information, she thought my case was denied and I or my lawyer appealed. But this is not true. My lawyer and I didn't any any denial notice and none of us appealed.

Recently, I call the customer service. The officer said my case was not denied based on the information she had. She also mentioned that since I had a denied I-140/I485 before, that may cause the confusion although these two I-485 are totally different applications. But she didn't give me suggestions on how to correct this confusion.

My lawyer insists my case was sent to AAO for name check and asked me to be patient and wait. I don't really buy this explainaton since I didn't see any case that was sent to AAO for name check.

Can anyone tell me what I can do now? how can I get my case out of AAO? Please advise! Thanks a lot!
