请教 六年延期
想谢谢这里的的所有热心人－上次PJIANG回答了我的急问，真是非常感谢。
本人情况。EB２，刚交I－１４０和４８５。两年前有申请过PERM／I－１４０（都批准的）
AC21:
# the H-1B non-immigrant is the beneficiary of an employment based (EB) immigrant petition (I-140) or an application for Adjustment of Status ; and
# 365 days or more have passed since the filing of a labor certification application, Form ETA -750, that is required for the alien to get employment based green card, or 365 days or more have passed since the filing of the EB immigrant petition(I-140).
第一次交PERM（有批准的I－１４０） 交的时间在H１B的５年前。后换工作。第二次交PERM （已批，又刚提了第二次I４０，及一次４８５）交的时间在H１B的５年后。这上面的３６５天是已那个DATE 算？
如果按第二个算，估计那个每年延一次H１B的行不通了。
查了旧贴。有人已经问过同样问题。在这里想确定一下这个是可以的吗？ 真能再有三年H１B吗

You must have your I-140 approved before H1 expiration.
Then you can extend H1 for 3 years. Forget about the pending > 365 days for the 1-year extention, you are no longer eligible.
有什么１）再具体的LIMITATION； ２） 法律参照？
因为怕４８５被拒， 所以想避免用EAD（已在交４８５时同时申请）。
