PJIANG老师:
I’m an H-1B worker and I plan to go to Canada for one week then come back to US. I don't have H-1B visa in my passport.
1. If I don't surrender my I-94 (which is on my H-1B approval notice) when I leave US border, how will the US border officer know that my trip between US and Canada is less than 30 days, when I re-enter the US? Which evidence can I show to the US border officer that my trip is less than 30 days?
2. What kind of documents do I need to bring when I re-enter US?
For example:
(1) H1-B Approval Notice (I-797 Notice of Action)
(2) H-1B Petition (Form I-129, three pages)
(3) Copy of Labor Condition Application (LCA)
(4) Employment Letter
3. How to process at the US border when I re-enter US?
Is it correct that I give the officer all the above documents, and the officer
will issue me a new I- 94 card and staple it in my passport? Currently I
don’t have I-94 card in my passport.
Thanks a lot.
