Hi PJiang: I am changing job now. I have two options: using EAD or transferring H1B.
My I-140 for EB(1)b was filed in July, still pending and I-485 was filed in August 1, 2007 of course still pending, but EAD was approved. I have EAD card in hand now. My current employer will not withdraw I-140/I-485.
After reading your paper on change of job within 180 days after filing I-185, I would like to use EAD starting my new job. But my future employer/lawyer ask me to transfer H1B other than using EAD, "because my current EAD card, issued based on my pending Application to Adjust Status, enables me to work in any position for the present time, even for another employer should I choose to do so. However, a change in my employment at this time may mean that I am unable to continue with existing permanent residency process. Additionally, my current employer may choose to withdraw the I-140 petition, causing my adjustment of status application to be denied along with my work authorization....."
What is your advice?
