RE: Recent USCIS Interoffice Memorandum regarding to name check and I-485 adjudication
It is well known that the USCIS recently issued an Interoffice Memorandum called “Revised National Security Adjudication and Reporting Requirement” (see attachment). In the Memo, it states that “Where the application is otherwise approvable and the FBI name check request has been pending for more than 180 days, the adjudicator shall approve the I-485, I-601, I-687, or I-698 and proceed with card issuance.”
My I-140 (EB-1b) was approved on September 9, 2005 (Notice Date), so my Priority Date is current. Your service center received my family’s I-485 applications on September 22, 2005. The FBI received name check requests from USCIS on September 30, 2005 (see the attached letter from FBI to Senator XXX). My daughter’s name check was finalized on December 19, 2005. However, my and my wife’s name check are still pending to our knowledge after a recent inquiry at the local immigration office in XXX. Therefore, my wife’s and my name checks have been pending for almost two and a half years.
In conclusion, our cases are available for adjudication based on the recent USCIS Interoffice Memorandum. I am looking forward to hearing from you soon.
