I searched this website and found the several similar cases as mine. I am looking for suggestion from the people with such experience. Your kind help is really appreciated.

I am a four-year-old girl’s mom. My hu*****and is working as a postdoctoral fellow at a university now. We came here with J visa and just changed our status into H two months ago. We have been separated from our daughter for almost three years. Her visa application was rejected several times even for her recent H4 visa application.

We plan to go back China. However, before leaving, I have several questions to ask. I know each case is specific and may not suit my situation. However, your experience will be a good reference for us. Thank you very much for your help.

1. Who is better candidate to go back China? H1(my hu*****and) or H4 (me), mom or dad ?
2. Should I apply for AP as backup? Will it have adverse influence on my daughter’s visa application?
3. When I came here, I filled “1 1year” as expected stay time in DS156 form. Will VO think it is a kind of cheat activity because I have been here for more than two years?
4. When I was a J2 visa holder, I worked as a technician in a lab. Will it be an excuse for VO to reject my application?
