Dear ,

I’m writing to express my strongest protest over the Visa Bullet for April 2008 published on the Web site of the U.S. Department of State on March 13, 2008. Although it appeared to have been taken down later in the day for unknown reasons, it created an extremely unfair situation in favor of one particular country’s employment-based immigrants.

As you see from Section D of the April Visa Bulletin, quoted below, of 180 nations in the world, India has been given a special treatment by the U.S. Department of State that made available to Indian-born EB2 (employment-based category 2) applicants visa numbers above and beyond the 7% cap per country, while China Mainland-born EB2 applicants, who have been continuously facing the same so-called “oversubscribed” status and been waiting for years upon years, were denied of this “special favorable treatment.” Quotation from the Visa Bullet for April:

“D. INDIA EMPLOYMENT SECOND PREFERENCE VISA AVAILABILITY
Section 202(a)(5) of the Immigration and Nationality Act provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter, then the unused numbers may be made available without regard to the annual “per-country” limit. It has been determined that based on the current level of demand being received, primarily by Citizenship and Immigration Services Offices, there would be otherwise unused numbers in the Employment Second preference category. As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially.”

Once again, this is extremely unfair to China Mainland-born EB2 immigration applicants. We’d like to request you to help us pressure the U.S. Department of State correct this blatant mistake and restore our faith in the equity, fairness and justice of the U.S. immigration system.

Finally, as a highly skilled alien worker with advanced degree (Master’s) from a top U.S. college hired under the H1B work visa by a well-known Silicon Valley IT firm, I have been making great contributions to the growth of U.S. economy and the diversity of U.S. culture with my strong professional skills and industry knowledge and my cultural background. It’s already unfair to us, particularly China Mainland-born professionals, that we had to be subjected to such unfair treatment as the 7% limit of employment-based immigration visa numbers, given that we’re already recognized for our work skills with the H1B visa.

This 7% limit puts most of us to an endless waiting for the visa numbers to become available, often up five or six years, during which period of time, we are deprived of any opportunities of pay raise or promotion or job change. Obviously, we are also deprived of any opportunities of making greater contributions to the development of the United States. The existing employment-based immigration visa restriction of 7% effectively created a discriminatory work place for Chinese nationals. We strongly urge the federal government and Congress to take immediate actions to create more visa numbers for highly skilled professionals from China Mainland and other countries, so as to also create a level ground of job market and work environment for us.

For now, we call on the Department of State to correct the Visa Bullet’s unfair favoritism to India-born EB2 applications and stop the discrimination against China-mainland born EB2 applications.
