Could you please help me? My company filed PERM 345 days before H1's max out date. In order to the meet the 365 days'PERM filing requirement to extend my H1B, I have two options:
1. Travel abroad for 3 weeks, and come back to recapture the time, which means I will be given 3 extra weeks, then the final max out date of my H1b will be postponed by 3 weeks. so I will be eligible to extend H1.
2. Convert to H4 for three weeks, then switch back to H1 to current my company. H4 status doesn't account the H1 allowable period. By filing the H1 petition, my h1b's max date will be extended three weeks.
Do you know if these options are workable? Which one do you recommend?
