(梁勇律师事务所，lianglaw.com专稿)EB-2 中国与印度的排期问题 2008年4月份的排期出现后，由于国务院对印度排期EB-2 的大前进做出了注解，引起了广大中国大陆出生人士的不满。主要是来自对Section 202(a)(5) of the Immigration and Nationality Act 中条款的疑虑。
在移民法 202(a)(5) 中，原文如下：SEC. 104. LIMITATION ON PER COUNTRY CEILING WITH RESPECT TO EMPLOYMENT-BASED IMMIGRANTS.
(a) SPECIAL RULES- Section 202(a) of the Immigration and Nationality Act (8 U.S.C.1152(a)) is amended by adding at the end the following new paragraph:
“(5) RULES FOR EMPLOYMENT-BASED IMMIGRANTS-
“(A) EMPLOYMENT-BASED IMMIGRANTS NOT SUBJECT TO PER COUNTRY LIMITATION IF ADDITIONAL VISAS AVAILABLE- If the total number of visas available under paragraph (1), (2), (3), (4), or (5) of section 203(b) for a calendar quarter exceeds the number of qualified immigrants who may otherwise be issued such visas, the visas made available under that paragraph shall be issued without regard to the numerical limitation under paragraph (2) of this subsection during the remainder of the calendar quarter.
根据移民法Section 202(a)(5)的规定，每一季度没有用完的优先名额，可以在“不受国家及地域的限制”来分配给其他缺乏名额的国家使用。EB-2 移民排期中，目前只有中国大陆及印度是需要名额的。在上个季度EB-2 其他国家的名额没有全部使用完的情况下，所多出来的名额就可以分出来给其中国及印度使用。
在2008年3月份的EB-2 移民排期中，印度的排期还呈现 Unavailable 的情况，而中国大陆的排期是在2003年12月1 日，在基于每一季度没有用完的优先名额，可以在“不受国家及地域的限制”来分配给其他缺乏名额的国家使用，由于印度出生的EB-2 申请人等待移民排期的时间比中国大陆出生者更久，在先送件的申请人就优先取得EB-2 的名额，所以印度出生的申请人先获得未用完的名额达到和中国大陆出生的申请人一样为2003年12月1日的情况。这并没有什么不公平的情况，若是类似的情况出现，而中国大陆出生的排期较长的话，受益的就是中国大陆出生的申请人了。
