My wife and I are both TN holder now. Both companies are going to apply H1B for us this year. However, my company may have a big wave of layoff within 90 days. So I have two choices before Oct. 1, 2008. One is to get a TD before Oct. 1, 2008 then change status to H4. Or I am luck enough to get an offer back to TN. So my questions are:
1. Can I get a new TN if my H1B application is approved before Oct. 1?
2. Can I change my status from H4 to TN?
3. Can I change H1B to TN if the next company doesn't want having transfering H1B?
4. How long will take to change TN to H4?
5. Should both of us cancel H1B application for the flexibility? (No GC)
