My priority date is Jan 2004, and I have 140 approved, 485 pending for over 1 year. I just got an promotional offer with my current employer. The company's lawyer said since the job duties are very different, they will have to do the following:
1. File H1B amendment
2. Refile the labor certificate, I140 and I485
3. I'm still able to use my original priority date.
My question is: IS IT TRUE THAT I CAN STILL KEEP THE ORIGINAL PRIORITY DATE?
