我的情况是:
我的non-profit H1B 4月4号结束,
capped H1B 4月1号递交,10月1号开始,
我4月14号上班时给HR看了我的I485 based的EAD,今天公司律师说基于AC21, 我完全可以以等H1B的身份上班。安全起见,让HR给我的I9 update成H-1B portability。

我的担心是我在4月4号- 9月30号这段时间只是H1B pending, 没有其他status, 这样合法吗?我的律师的说法对吗?

下面是律师的email, 请各位老师指教:

“As you know, once an H-1B petition is filed to USCIS and receipted, you have authorization to commence the employment pursuant to Section 105 of the H-1B portability provisions appearing in the American Competitiveness in the Twenty First Century Act (AC21). This is premised on the fact that you were previously employed in H-1B status and are now porting to a new H-1B employer. This employment authorization remains valid, unless the H-1B petition is denied by the USCIS, which is an unlikely event in this case. In this respect, you are not relying on the EAD for work authorization and do not have to do so.“
