H1B 10月需要延期,只剩下三年了. 140 去年六月批准的, 485是去年七月交的. 今天给HR和律师TC讨论H1B延期的事. 律师告诉我,以后最好用EAD.

-better to not get the H-1B extended and to keep working on the EAD.
-Since your PD is Nov 2006, in the following two years, your case will not
be reviewed (very likely) .
-In the event that the Adjustment of status is denied in 3 years for example
, since we did not use extension, you can leave the US but then could come
back in on an approved H-1B for an additional 3 years.
-If you use all the H1, you have to stay out of US for lat least 1 year

如不用EAD即使I485被拒也不用30之内离境，对吗？

如维持H1不用EAD即使I485被拒也不会有30天之内离境的危险，对吗？
