I worked for the company in R division for 5 months then, I got laid off. A few months later I was rehired by the company and have been working for M division for some years. The two positions are different.
Can I use some specific experiences, which I gained from R division to meet the requirements of the PERM application for my current position (in M division). The company’s lawyer said I need to have the specific experience prior to joining the company.
Is the lawyer right?
