My wife filed NIW I-140 May 2003, and filed I-485 for both of use June 2003. But the NIW is soooo... slow at Vermont Center.
Now I got my LC from my employer and am ready to file my I-140 and I-485. Can I file another I-485 while the old I-485 pending? My lawyer told me I cannot file two I-485. But I still wonder if this is really the rule. Can I file two and withdraw one when the other is approved.
You know my dilema: I will lose a year if I have to withdraw the old I-485 now. However, if I keep the old I-485I and don't file mine now, I may waste a lot of time before I can file my I-485 if my wife's I-140 is rejected. Is there any way to get around this problem?
