To make a long story short, I have two approved 140. The first one is under RIR EB3 with an earlier PD, and I filed 485 associated with it during last July fiasco. The second one is under PERM EB2, which was file before 485 but when EB3 140 was still pending.
The strange thing is they were approved at the same day. And surprisingly, USCIS put the earlier PD on the approved notice for the EB2 140. I read your post regarding switch EB3 to EB2. Seems you need to file an application to recoup the earlier PD, which my attorney did NOT since the EB3 140 was still pending at that time.
My question is whether my 485 will be automatically linked to the earlier PD? Or as my attorney explained to me, since USCIS already put the earlier PD on the EB2 140, the 485 should be linked to that PD too? This is extremely important since next month my PD will be current according to the latest Visa Bulletin if the earlier one is used. Could you give me any advice?
