I am currently work in the States under TN Visa, My hu*****and is gonna be the main applicant for green card and he will soon file I140, I485, EAD, AP for our family cocurently. At the same time, my company is willing to sponse my H-1 application to change my TN to H-1b.
My question is:
1. Do I really need to file this H-1 application? Would the INS know my immigration application and deny my H-1?
2. Is there any benefit for me to file H-1 (I am sure my EAD will come first)?
3. Once my EAD comes, does it mean my TN automatically expires or I can choose not to use my EAD until my TN expiration date (Feb, 2005) or until my H-1 is approved?
