I got receipt for a H1B transfer, already started to work for new employer for a couple of days after receiving the receipt
The previous H1B was started by the end of July 2008, and I stopped work in the middle of Auguest (laid off by client company, H1B holder is a consulting company)...then got another company's offer for H1B transfer.
THe problem is: My previous company pay salary monthly, not bi-weekly, so
when we filed H1B transfer in early september, I just have one July pay stub on my hand to provide, I have no Augest's pay stub (which is supposed to be paid in the middle of September). Now I still didn't receive my Augest pay stub,it seems like the previous employer play game with me...? (they said it has been sent out, but obviously I can not recive it)
I am waiting for Augest pay stub for in case USCIS want a RFE for Augest pay stub.
My question is:
1. can I have a H1B trasfer without needing to file RFE for latest pay stub like my case?
2. If the previous employer didn't or delay to pay me, how can I do?
(The wrost case is when USCIS want RFE for Auguest pay stub, but I don't have, maybe I am arguing for my paystub on court, how can explain to USCIS?
