My hu*****and (Canadian Citizen) applied for EB2 I-140 at work in 07/2007. We applied I485 in 07/2007 with I-140. He got denial notice this summer for EB2 but he was approved for EB3 recently. May I know what happens to our I485 now? It was denied shortly after EB2 was denied but now reopened with the EB3 approval. EB3 for Canadian is back logged at 5/2005. If my hu*****and switches his job now, are we qualified for 'portability provision'? Does the time from 07/2007 (when we actually applied 485) to now still qualify as the 180 days? When he leaves, do we get to keep the GC assuming the current company doesn't revoke?
