我是绿卡的主申请人（EB2，去年七月递交I-485。PD是06年九月。）我的LD去年六七月公司裁员。因为paycheck一直会发到去年11月，所以，我们当时理解是他的H1B会一直有效。于是我们到了11月才为他递交了H1B转H4的申请。其后，除了receipt notice,移民局没有给我们任何消息。
今年，他申请了新的AP和EAD（原来的AP和EAD是和I-485同时递的，但只用了AP，EAD没用过），都获得批准。可是前两天，我们突然收到移民局关于他的I-539 APPLICATION TO EXTEND/CHANGE NONIMMIGRANT STATUS的notice of action: 原文如下：
“USCIS is in receipt of the Application to Extend/Change Nonimmigrant Status (Form I-539) that was filed on November X, 2007, requesting a change of status for XXX (LD的名字). In order to process this application, additional evidence is needed.
Title 8, Code of Federal Regulations, Part 248.1(a), provides that only an alien who is continuing to maintain his nonimmigrant status may apply to have his status changed. Service records indicate that your H1B status expired on July X, 2007, and this application was not filed until November X, 2007.
Please submit evident that you were in valid status at the time you filed this application. This may include but is not limited to a copy of the latest 797 approval notice.
If your status has expired, please give a statement of explanation.”
我的理解是，他失去h1-b的原因有两种可能：
1. 因为已经递上了I-485,所以身份变成AOS。这个有点费解。因为，我原来的理解是，只要不用EAD，他就应该还是H1-B的身份。
2. 因为原来的雇主提早通知了移民局，于是LD的H1B在七月就作废了。
您认为是哪一个原因呢？
因为我们直到11月才要求转他的身份。这是不是意味着，他的nonimmigrant的身份出现了空档，所以就失去了转H1-B或H4的可能性？
那么，我们怎么答复移民局的这封信呢？还有LD是不是从此不再可能有H1-b的身份了。现在他找到了一份工作，是不是只能用EAD了？
