My mom came to take care of my son in September 2002. Just one month before her leaving, I hurt my back and cannot do any housework. I filed visa's extension for her and got approved for another six months. My mom left American in September 2003, a few days before her extension expired.
My mom applied for visa again in July 2005 before my daughter was born. She got denied because of her one-year stay in 2002. Then she got denied again in September 2005 and July 2006 with the same reason.
My mom argued that it's a legal stay and provided the approval letter and my X-ray results and doctor's notes. However, the officer insisted that my mom stayed one-year while she only claimed 3 months on the application form.
I want my mom to try again in Janury 2009. My mom is so nervous and afraid of another denial. Does anybody have any suggestions on this case? Millions of thanks in advance!
