我持有H1B在学校搞RESEARCH, 去年11月FILE的NIW I-140, 还没动静.老板对我的工作不满意,H1B这次只延长至4月底.我还只有1个月多一点的时间了.
我找的下一个工作,还要重新申请H1B,如果有GAP怎么办(比如一个月)?对我的H1B或NIW的申请有影响吗?
还有我听说在NIW FILE 180天之后才能换工作,是真的吗? 同一个学校的也不可以吗?
还有如果转F2,是不是我的NIW就作废了?

-If just one to two month gap, you may have no problem for H1. Most likely, your new H1 will be approved without I-94 and if so, you just need to go out of US to get an H1 visa to activate it. The gap will never affect your NIW I140, no matter how big it is.

-Not true. You can change your job anytime with NIW as long as the new job is in the same/similar area as the old one indicated in your I-140.
还有如果转F2,是不是我的NIW就作废了?
-No. But I doubt your F2 application will be approved due to your immigration intent

这是指若H1B延期在我的H1B结束前FILE,那么我就不需要离境,但H1B延期在我的H1B结束后FILE,那我就需要离开US,到MEXICO或CANADA去重新申请签证入境,是这样理解吗?
