EB2 I-140 and I-485 filed in 4/2004 TSC.
I-140 approved in 8/2005.
Contacted with the USCIS Ombudsman twice in 9/2008 and 12/2008.
I was informed by Ombusdman that everything is OK except finger print is out of date, but she can not promise a date.

On 3/9 2009, TSC and US Attorney Maryland Representative received the summons. On 3/16/09, USCIS and US Attorney received the summons.
On 3/19/09, US Attorney MD representative told me that my application had been approved and he needs my permission to dismiss the law suit. When I got home, I did find the card in my mailbox. The approval date on the card is 3/13/09. Interestingly, I have not received the I-484 approval notice, which usually comes first.
Yes, USCIS is proved to be very efficient again if you sue them. They will become even better if everybody does so.
