This is the last year of my H-1B and it will expire on 6/30/09. I should be able to recapture 109 days, which means my H-1B can be extended to 10/17/09.
My EB2 PERM application was filed on 4/7/09. My PD should be/will be current.
The worst case I'm expecting is that I leave the U.S in early October 09, and won't be able to come back until I can get one year H-1B extension after 4/7/10.
My question is, if I'm lucky and my PERM is approval early (say before the end of 2009), is there any chance that I can re-enter the U.S. earlier than 4/7/10? And if so, how?
