请教PJIANG老师: Dear Pjiang, I need your kind help. Here is my case:
Around May 2005 filed PERM, got approved within 4 weeks; August 2005 filed both I140 and I485. I140 got approved in Feb 2006 and file transferred to local. Received notice of interview at Feb 16, 2006 concerning my arrest in the I485 survey. Interview was good and seemed I just needed to wait for the quota.
Nothing happened until at the end of 2007 received notice of denial of my I485 application due to CMTP related to the arrest. Filed Motion to reopen within a month after the receipt of notice of denial.
Nothing happened again until in the end of 2008 received revoke of the notice of denial, same time, received finger print notice. Now I received a notice of interview, requesting medical examination, court deposition of my arrest, last three years tax returns with proof of filing etc. which already submitted along with my application of I485 back in 2005. I would like to know your kind inputs concerning this interview:
8226; Do I need to order another court order of expungment of record, as I already submitted this during my previous interview related to this arrest at 2006 Feb? The letter says it should be original copy.
8226; Do I need to do another vaccine and medical examination, as I already did this when I filed my I485 application?
8226; How do I provide the proof of filing for my tax return? I meant for this year. I haven’t gotten my refund yet.
8226; Is it necessary to hire my layer to present for me? My lawyer said this is unusual and the interview signals a heightened need for representation. He charges $650 for be present and says that way I will be well prepared.
The nature of my arrest is domestic violence. 8 years back I had an argument with my wife, and involved a little physical contact. She called 911 and I got arrested. I was released the 2nd day and paid handsome price for this case, and even now I am still paying. The case was expunged on conditions that I attend batter education and other things.
