I have a valid 1 year OPT EAD card starting from Jan. 2009, and I started working with this OPT EAD one month ago. Recently I got the approval notice from my AOS EAD along with my I-485 application (dependent of my hu*****and's Eb1 green card application). My question is whether it was illeagal to use the OPT EAD to work before the AOS EAD card was approved? If the answer is yes and the OPT EAD was used instead of the AOS EAD, whether my I-485 application will be compromised and/or what are the other consequences? I am very confused as some lawyer says F-1 status is automatically invalidated as soon as the I-485 is filed so does the OPT EAD; while some others say as long as the AOS EAD/AP is not used, previous non-immigration status can still be valid. If it's OK to use OPT EAD to work in the beginning, do I have to report my AOS EAD to the human resources when I receive the card--considering the fact that OPT holder pays less tax such as no social security and medicare taxes.
