My hu*****and filed NIW I140/485 on July 2007 and his NIW 140 approved while NIW 485 is pending. He filed EB1-B 140 last month. But we didn't ask for relink 485 to EB1-B if EB1-B 140 get approved. Can I file my 485 based on my hu*****and's EB1-B 140 application with NIW 485 pending? We don't want to waste money to file another 485. Some people said the USCIS may cash my check and deny my 485 application. Will this happen?
