My son came in US at EWR on Aug. 13, 09. The officer didn't match his H4 experiration date to mine, instead to the expiration date on his visa which is less than 3 months. We went back to EWR, a lady didn't have it corrected and she suggested to file I539 ($300). I talked to a laywer and she will charge me $950 plus $300 filing fee. I took chance today going to JFK, where we had it done in a min. So, if someone has the same problem, feel free to try the different location of CBP.
