我7/20/09 layoff (last pay check date), 7/29/09 filed I539 H1->F1 (paycheck submitted up to 7/12/09).
Received RFE sent on 9/30/09:
"The record indicates that you are currently employed in an H-1B nonimmigrant status and are now attempting to change status. Submit your pay records (leave and earnings statements, and pay stubs, etc.) for the period of July 12, 2009 to July 31, 2009 to establish that you have been maintaining a valid H-1B status."
I have the last paycheck (period ending: 07/20/09) and a severance paycheck (period ending: 08/09/09). I intend to submit both and hoping USCIS will take the severance check date, or just close one eye on my OOS gap between July 20, 2009 to July 29, 2009.
