I am a junior faculty member at a university. I was just informed by the International Student & Scholar Office that I cannot file for a green card through EB2 perm processing because it has been more than 18 months since the start date on my initial permanent offer letter. Does it mean that I cannot get a GC through EB2 if my school is not willing to do the advertisement process again for my position? Does anyone have similar experience? Here is my situation. When I started this job, the school gave me an initial permanent offer letter. And then they changed it to a temporary offer letter when they realized that I had not defended my dissertation yet. After I defended my dissertation, they issued me a second permanent offer letter with a different date from the first one. In my situation, Does the 18 month rule start from the date on my 1st, or 2nd offer letter? The date on my first permanent offer letter is more than 18 months ago, but the date on my second permanent offer letter is just 3 months ago. Thank you very much for any suggestions!!
