老婆终于在本地找到工作，可以不再两地。没想到挺大一个跨国公司却碰到一个毫无经验的公司律师，实在麻烦，一个LCA申请搞了一个月才发出去，中间不知道回答了她多少无厘头问题。我和老婆都办过H1B的，有很多太无厘头，我们都一一解释给。
现在碰到一个超级无厘头问题，情况如下：老婆现有H1B第一个三年明年九月到期。这
个律师要申请把H1B receipt送到加拿大美领馆，让老婆出境激活新H1B,而且新的H1B只
到明年九月止，到时候再延。
“Our attorney indicates that it would be preferable to update your H-1B
status once your visa is approved so that the documents are in alignment;
same expiration date. Because you have landed status in Canada (no visa
needed), this can be easily accomplished by having the paperwork sent to the
Consulate in Toronto ; when you return, the I-94 will be reissued and the
information will align with the new petition. At some point, this will need
to occur because your current visa expires next September.”
有两个问题
1，H1B transfer除了不占名额，等于全新，应该是又一个三年，是否正确？
2，老婆没有任何Gap不需要境外激活，应该拿到797A,上面的I-94直接取代旧I-94。如果万一拿到797B，考虑不迟，是否正确？
