I140 approved and I485 pending for 2+ years. my PD is 2006/12 so I guess it will be at least 2-3 years before green card. I am on the extended H1B(beyond 6years) my spouse is working on EAD as dependent to my petition.
Now I got an offer from another company to go work in China (hired as US employee and work in china as expat). will travel frequently to US (monthly?)
I read Pijang's blog but still feel uncomfortable with the following -
1. Does AC21 apply to me? I am not sure since I will be primarily work outside US.
2. if yes to 1. Do I transfer H1B or work on EAD? I will be on their US payroll.
3. I'd better change I485 to CP, right? But if I change to CP, will that impact my spouse's I485 and EAD?
4. what's the worst that could happen if I accept this offer?
Sorry for all the questions. but I really liked the new opportunity but all the immigration stuff make it complicated.
