Pijiang, PLEASE HELP! My labor certificate is pending; H1B will be expired in 16 months, when shall I apply the extension of H1B? How many years can I extend? If I get approval of H1B extension but later on labor certificate is denied, which date shall I take as my H1B expiration date?

how many years have you been in H1B status?

I've been almost 5 years

my understanding is you can only extend it after 140 approved

so you need to push to get the LCA approval first, then

LC is under audit; they are still processing 2007 Dec audit case

my perm pending is over 1 yr, can I extend my H1B now?
