我现在想换工作。现在有个问题请教：
在我H1B transfer申请 pending期间，老婆想回国俩个月。在我的case pending的期间，她返签H4会有问题吗？ 还是必须等我h1b transfer approve 以后， 她才可以去签证啊？

I think I have to write to you directly. I talked with Katherine in your office a few times on my wife’s case. My wife is travelling back to China next week, and her H4 visa already expired in November 2008, so she has to apply for re-entry H4 visa in Beijing to come back to US, so I think I need a premium processing for my H1B petition so that she can apply for her visa. I think she will have problem to get her visa approved if I have a pending case.
Katherine insists that my wife does not need to apply her re-entry visa to come back. I do not know where did she get those information, but I think it is absolutely wrong.

Katherine asked me about it. You don't have to have the H-1b approved for your wife to get an H-4, but if you prefer to do premium processing that is fine. It makes it easier for the consulate to understand.

The paralegal (Katherine) is quite stupid, and gave me a very irresponsible answer saying that my wife does not need to apply for a reentry visa. That is funny and not professional.
