FEIN is used to file LCA document with the Department of Labor first for H-1B petition.
The Department of Labor will approve the LCA upon approval of the school's FEIN number (Federal Employer Identification Number).
Please provide the copy of at least one of the following documents which cleary note the FEIN:
1) Documentation from IRS noting assignment of FEIN
2) Federal or State tax return (only acceptable with a pre-printed label) or a pre-printed tax coupon
3) Documentation from employer’s financial institution showing employer’s FEIN
4) Secretary of State registration documents
5) Official and/or government documents or
6) Other documentation showing the FEIN and name of the employer
We just did it by the end of last year. We initially used school's W-9 showing FEIN and name as well as President's signature. But it was not sufficient. Then later we changed to an approval notice issued by DEPARTMENT OF THE TREASURY INTERNAL REVENUE SERVICE inrepsonse to school's SS-4 (Application for Employer Identification Number
(EIN), in which the school name and approved EIN were shown. In this case, LCA was approved.
