My lawyer said we will use the name on my degrees, applications, birth certificates and etc, (which has one more letter than on my passport), and to have two affidavits from people 16 years older than me to prove that I am the one with the name with one more letter. I think USCIS will use the name shown on my passport, but my lawyer insists to do so.

On my old passport, there is an annotation says "the bearer is also known as (the name with one more letter as shown on my I20, SSN, degrees, birth certificates)". But the Chinese consulate general in NY won't add this annotation, said need court proof of name change or green card. The fact is even if I have court changed my name from now on, I still cannot prove I am the person with that extra letter.

I think I will bring my birth certificate to a notary stating that my Chinese name can be spelled as both, and the one I used sounds closer to the Chinese character.

I will need to go to the Chinese Consulate general in NY again, to require a name annotation. This will solve everything and it is official. Not sure if it is ok to show them my previous student ID? Sometimes you have to say those officials in the Chinese consulate won't help their own people out.

My lawyer says if my EAD get rejected, I will have to restart the process again. Does this mean to restart my GC process from Labor?

Please help me out. My brain is totally messed up.
