I filed NIW I -140 and I-485 in July, 2007, and my I-140 was approved in October, 2008. Since 2005, I have been working on an H1B visa, although I held a valid EAD most of the time since Oct, 2008 (current EAD is valid from 04/17/09 to 04/16/11).
Before June 30, 2009, I worked in University A on an H1B visa that expired on June 30, 2009. Since August 1, 2009, I have been working in University B on an H1B visa with valid date from July 20, 2009 to June 30, 2011. I did not work and received no pay for the whole month of July, 2009, and during this period of time, I was visiting my parents in China and returned on July 29, 2009 with AP. Today, I was told that I have some trouble, and the following is the information from the International office of University B:
1. You were given a one year parole period to apply for a green card, ending July 29, 2010, when you re-entered the U.S. in 2009.
2. Right now you are working in the U.S. on an H1B visa because your EAD card has never been presented to Olga.
3. You must leave the U.S. and then return to the U.S. within 180 days after July 29, 2010. (You have already used up @ 75 of the 180 days.)
4. If you stay in the U.S. longer than 180 days after July 29, 2010, the bans go into effect and it will be 3 to 7 years before you can come back to the U.S.
5. After you re-enter the U.S. on your H1B visa, then you can apply for the EAD card and work permit.
6. Because you applied for the Green Card on your own, we cannot assist you with the application process in any way.
