My wife  filed her parents B2 extension online, but mailed the supporting documents to the wrong Service center (DSC), it should be CSC. The documents was returned by the DSC, but the CSC also mailed us the denied decision, which is made based on no supporting documents.  The problem is their I-94 has already expired a couple weeks ago and we have rescheduled their flights to October, 2011. My questions:

1. We would like to motion to reopen by sending the supporting documents and explain why, is it worth it?

 

2. During motion period, can they stay here legally? Since their staying here is already overstay, will this overstay automatically fail the motion to reopen?

 

3. Just call USCIS, told us if we have filed the motion, their stay is not count as OOS until a decision is made, just want to be sure.

4. Any one has similar experience to share? 

5. Last but not least, the fee is $630, not cheap!
