In 2006 we submitted I-140 both NIW (EB2) and EB1, I-485 was also sent out together with EB1 since EB2 not current.
A year later (2007) EB2 I-140 was approved easily, but EB1 I-140 was denied even after giving more evidence per their request. Then we did appeal for EB1 in order to keep our I-485 there, but a year later (2008) the case failed.
However, our I-485 is still alive, and we got our EAD, and my hu*****and began to work with his EAD, but I still work with my H1B visa even though I had EAD too. During the time, my hu*****and did another fingerprint, I didn’t.
In 2007 people can submit EB2 together with I-485, but we didn’t submit another I-485. We assumed that our I-485 was linked to our approved EB2 since our EAD was renewed successfully. Also we were requested to submit some evidence for our medical files.
Luckily it is our turn on July 2011 to deal files submitted on October, 2006, and on July 15, we got the cards.
