My wife's H4 visa application was denied because of intention of immigration, which is really out of our imagination. Pretty much everybody says that H-visa applicant can have intention of immigration. The visa officer gave her the rejection notice of 214(b) and said that all non-immigration visa applicants have to show no intention of immigration. But the 214(b) file clearly says that student (F) and visitor (B) has to show no intention of immigration. It does not include temporary worker! Any H4 applicant ever had similar experience?
I really believe the visa officer was abusing his power. Is there any way that we can appeal for her case? I understand that Beijing embassy only allow American citizen to appeal for an unfair visa interview. Does anyone know an immigration lawyer in Beijing who is an American citizen? Sure we can make another appointment and take some documents of immigration law with her. But a nice attorney is much better at handling odds.
Any help will be really really appreciated.
