My EB1 I-140 was filed one month ago and got approval over two weeks ago. My I-485/765 applications were just filed to USCIS. Due to my current 6-year H1B expiration soon, I have asked my employer to file a H1B extension -- Thanks to 863211's comments on my question regarding this a few days ago -- However, the immigration lawyer of my employer said that my PD is cureent and can file I-485 for AOS and 765 for EAD, and my I-140 (filing date) is way less than 365 days, thus I can not apply for either 3-year nor 1-year H1B extension. Is this correct? Which regulautions are referred?
